Violation of Effective Judicial Protection in the Recognition and Execution of Foreign Judgments in Ecuador

Because of the increase of international conflicts, the development of Private International Law is essential. The basis of this area are three fundamental pillars. The exequatur is one of these. The importance of the exequatur races because of the necessity of the extraterritorial validity of the decisions that solve international private situations. The following article analyze the efficiency and effectiveness of the Ecuadorian legal system corresponding to the different procedures for the execution of the different types of international awards, and their compatibility with the principle of effective judicial protection.
