Towards a Specialized Constitutional Justice (The Case of the “Action for Protection”)

The structure of the justice administration determines the competence (powers) of the jurisdictional bodies, among them, the ordinary judges who deal with the so- called jurisdictional guarantees such as the “action for protection”. Judges must fulfill constitutional principles such as the so- called principles of haste, informality, and simplicity. Based on quantitative studies and Constitutional Court rulings, it will be shown that the action for protection is not seasonably resolved due to different factors. Hence, the pertinence of a specialized constitutional justice system within the Ecuadorian State will be examined.
